Intellectual Property Court outlined at US-China IP summit

A brief introduction of the Intellectual Property Court of the Supreme People's Court (SPC) was given at the second US-China IP Summit on Jan 3 in Shenzhen.


Wang Chuang, vice-president of the SPC's Intellectual Property Court, explained the situation of the court including the reasons why it was established and its function and role.


At the summit, Randall R. Rader, former chief judge of the USCourt of Appeals for the Federal Circuit, regarded China as a preferred place to resolve patent-related cases as they are handled at the SPC for the second instance and are tried under a unified judging standard. The lawsuit period is also shorter.


Prof Mark Cohen of the University of California, Berkeley, pointed out that the court will benefit the patentees and will raise people's IP protection awareness.


The summit was sponsored by the Intellectual Property Law Association, the Intellectual Property Academy of Renmin University of China and the Nanshan government in Shenzhen, with about 80 judicial experts, scholars, lawyers and enterprise delegates in attendance.


Also present at the conference were He Peng and Xu Zhuofu, judges at the SPC's Intellectual Property Court.
