Development Urged of Diversified Technical Fact Investigation Mechanism

A seminar on construction and development of diversified technical fact investigation mechanism was held by the Intellectual Property Court of the Supreme People's Court (SPC) on Nov 8.

The developments and constructions in diversified technical fact investigation mechanism of people's courts in the past five years was reviewed during the meeting.

Luo Dongchuan, vice-president of SPC and chief judge of the IP Court, stressed that relevant plans should be made by all levels of courts who have jurisdiction on technology-related IP cases, according to their real needs for trial, on the implementation of mechanism construction to guarantee that IP cases related to technical issues are solved by the courts with high efficiency and quality.

Luo encouraged those courts to develop technical investigation teams and to centralize management by specialized departments.

The SPC should play a leading and guiding role in completing the technical investigation resource sharing mechanism and in working on regulations to clarify specific proceedings such as application, coordination and dispatch, Luo added.

Luo also emphasized strengthening the leading role of judges. "All the judges who trial technology-related IP cases should improve their technical knowledge and related cognitive competence for better and more efficient work in technical fact findings." Luo said.

The establishment of a national court technical investigator talent database and the opening of a technical investigator sharing mechanism were announced at the meeting.

A handbook on technical investigators was also released.

Also attending the meeting were experts and scholars from various institutes, including the China Association for Science and Technology, Peking University, Tsinghua University, the University of the Chinese Academy of Sciences and Zhongnan University of Economics and Law, as well as staff members from other branches of the SPC, Beijing, Shanghai and Guangzhou intellectual property courts and the IP Court of the SPC.
